Legal Question in Family Law in Florida

Hello. My son's biological dad has accepted to sign consent in order for my husband to adopt him legally. My husband has been a father for my son since he was 2 years, and he is 8 now. I was wondering if this a process that we can do ourselves because it will be easy since we will have consent from bio dad. We are in Florida. We asked a lawyer but she quotes 2k to do process and we don't have that. Thanks.

The Florida Supreme Court has most, if not all, family law forms on its website. From that standpoint, the Court has made it easier for you to represent yourself in family law matters. "Can I do it myself" is a question that can have 3 meanings: 1. Is this something the law allows me to do? The answer is yes. There are only a few types of cases in which you must hire an attorney, by law. This is not one of those kinds of cases. 2. Is this something in which I am willing to invest the time to learn? Do I know how to get a hearing? Do I understand the consequences? Do I know where to find information? If you have the time and the inclination to research the law, sure, this is something you can do yourself, as long as you also know how to make a legal argument. When you get to Court to persuade the judge to go along, you have to make a legal argument, not an emotional one. 3. Is it a good decision for me to represent myself in an area of law that I know nothing about, or should I hire a lawyer who knows what to do? Who drafted the consent? did you get it off the internet, or worse, draft it yourself? How do you know that the consent form is binding under Florida law? Does the consent need to be witnessed? What happens if it isn't? Go back to #2 - think about how much time it will take for you to research everything, and how much your time is worth. Do you even have a law library in your town? If not, how would you research this? (Don't even say the word Google...).

Good luck with whatever you decide. Sounds like you have a great husband.

I suggest you obtain an attorney. Shop around for pricing. Not all attorneys charge the same amount. Good Luck and Bless your Husband .
