My son's biological father didn't sign his birth certificate, he is now 4 yrs. old. Since he didn't sign the certificate and hasn't had any contact in over 3 yrs., can he fight me in court if my husband wants to adopt my son?

Yes, in order for your current husband to adopt your son, you would need either the biological father's consent or the termination of the biological father's rights. The birth certificate is mostly irrelevant. If the biological father won't sign over his rights, it will probably take more than three years' absence from your son's life for a judge to order termination of the biological father's rights.
