Legal Question in Family Law in Florida

my sons dad doesnt let me see my son

My ex and I broke up because he was very physically abusive. Once I finally got away from him and we made an agreement that he would have the baby Monday through wednesday and I would have him thursday to sunday. He still trys to control me and wont let me take the baby unless I go out to the movies with him, have sex with him, and call him and let him know what I'm doing at all times. I finally couldnt take it any more and stoped talking to him. Now he will not let me see my son at all. I filled out paper work for temporary emergencey custody and was denied even though my sons father has threatend to take my son and move to New Jersey with out my permission. It has been a month since I've seen my son and I don't know when I'm going to see him again. I just want to find out how I go about getting custody through the courts so that I can see my son and not have to worry about him leaving the state with my baby.

Retain counsel. You are out of your league.

Florida law forbids him from moving your child more than 50 miles from his current address.

If there is no current custody order, you may be able to simply go get your son, but I wouldn't do anything without talking to a custody lawyer. I'm not sure, based on what you've said, that your ex even has any fathers' rights at this point. He may not have the right to even have visitation with your son. Again, check with a custody lawyer.
