My sons father kidnapped my son, and his name is NOT on the birth certificate. If the fathers name is NOT on the birth certificate, can i charge him for kidnapping?

YOu could but if proven he is the father, then you would be charged with a false police report. While there are no papers filed in this matter, go get your child. The police will not interfer because both of you have custody and this will be considered a civil matter. So if he calls the police , fine they will tell him the same thing. You can do one of two things - run to the court house and get an order to pick up your child or you can file for emergency temporary custody, support and other needs and have the juidge review as to whether he will issue the pick up order.
