I can't believe his attorney will not accept the summons. That's foolish and just plain rude. I assume you've tried service with the sheriff's department, and they've been unable to find him. Your next step is to hire a private process server to find him and try to serve him. If that process server gives you a notice of non-service and an affidavit of diligent search, meaning that they have done their best to find him and serve them, then you are permitted to serve him by publishing a notice in the newspaper. No one will ever see the notice, you'll probably win your case automatically when neither he nor his attorney show up for your hearing, then he can go screaming to his attorney about why his attorney wouldn't accept your summons.
