my sons mother just left out of state with my son. neither of us have custody but he's been living with me and has been attending school near me. she left to texas with him without my consent, and says shes not bringing him back. is that legal?.

No. She needed court permission to relocate. The court will look to the best interests of the child.

Without knowing if you were married to the mother or if you filed a petition for paternity - its tough to say definitively what your rights are. However, regardless of the legality at the present time, there are certainly steps you can take to attempt to have the child returned to Florida.
