Legal Question in Family Law in Florida
spousal and child support
I am not working by the demand of my husband desided to leave USA for Emirates without me and 2 children.Wouldn't even file for a divorse and already applied for visa and has tickets. There is no arrangement for child support. How do I stop this and make him sign papers before he leaves? This whole thing unraveled while I was traveling with children in Europe.I will be back in US only Aug. 24th and his tickets for the Aug 26. How can I prevent him from dissapearing? He is sure that I will have no access to him in Emirates since he is a sitizen of Algeria and I am sitizen of Azerbaijan. We got married in USA. One of my kids is US sitizen. He always was on the way of my carrier and his final demands in 2006 were to sacrifise my job or hi will leave kids. I accepted and now he is demanding us to moove to Emirates or he will leave us penniless. I will stay in US and file for a divorse. What sould I do? I want full custody of both children, child and spousal support, return of ALL his debts to me that he had before the marriage, return of ALL my family antique jeweleries that he borrowed when he was in financial trouble, payment for jewelery that he broke and lost that I owened before the marriage, jewelery that he owes by prenup.

You can file an emergency motion preventing him from taking the children out of the country and asking that he turn over the children's passports. You can then resume or start the divorce proceedings that will include dealing with your property and custody issues.

If you do not agree, then stop right here, and do not read any further.
You will need to retain a qualified divorce attorney who can file an emergency petition to prevent any attempt by him to take the children with him if he leaves. Your attorney can advise you of the necessary procedures to seek the rest of that which you seek, although if he does return to Algeria, it may never be enforceable if he does not return to the United States. At the least, a judgment may be entered that will accrue in his absence and, if he does return, you can enforce it at that time.

You need to get an attorney as soon as possible because you can't do any of this without one.
