Legal Question in Family Law in Florida

Spousal Financial Responsibility

I am married for second time. My husband is facing a serious surgery for which he does have medical coverage. I have monies in my name alone. If my husband were to go into nursing home or need specialized medical care after surgery, am I personally responsible for payment of these services? Could my assets be attached? We do have a home together in both names. It is our homestead in Florida. Thank you.

Re: Spousal Financial Responsibility

Florida's Homestead exemption only applies to your home. I would need more information to answer your other concerns.

Yes, your assets may be vulnerable. I suggest you speak with an Elder Care Attorney
