Legal Question in Family Law in Florida
Former Spouse already rec'd QDRO
The Judge ordered a 3rd one for attorney fees which was done originally the order stated that the attorney would be the alternate payee which could not happen. The the QDRO went thru for ex, but it is a life annuity & will pay $575 before taxes so it will take over 15 yrs to collect what opposing counsel claims is his fee. Now they think they will do a 4th QDRO for more attorney fees, interest, & federal taxes but there is no more funds in the pension that could have been marital. Divorce was final in 11/2000, original QDRO was done 7/2001. 4yrs ago my husband changed employers. How can they claim it is marital? Believe me the Judge will sign anything opposing counsel presents & denies us hearings.

Re: Former Spouse already rec'd QDRO
Attorneys's fees can be awarded from non-marital funds, so perhaps that's the reason for the new QDROs.
