Legal rights of a person in the described circumstances depend on: 1) whether the separation was a legal separation under FL law; 2) any terms of a marital separation agreement signed by the parties; 3) relative financial circumstances; 4) significant change in circumstances since the separation; 5) period of time spouses lived together in their marriage; and 6) special circumstances not included in the inquiry such as minor children. So, the general response is "yes, but there are several factors governing the outcome.
Florida does not recognize a legal separation without some document to support that. However, there will be factors considered that will offset the amount a spouse could receive.
