Legal Question in Family Law in Florida
I started paying temporary support to my wife on Sept. 1, 2010 of $1,500 per month as our divorce was about to go to trial on a bifurcation regarding post nuptial agreements. I paid the first payment on August 27, we went to trial and we are waiting for the judge's ruling. Then, last Thursday and Friday my pet was hospitalized, receiving emergency treatment amounting to more than $1,000 which has made me unable to pay the temporary support on or before Oct. 1. I will be able to pay it when I get paid on Oct. 8.
My question is, out of consideration for my wife's budget and her plan to receive payment on time, should I notify her of my expected delinquency of the temporary support payment? Please don't suggest borrowing the money. I am tapped out to the point that the folks at the local pawn shop are tired of seeing me. I never knew they don't take vacuum cleaners :-)
Would a judge look favorably on a notification of expected delinquency?

contact her about the delay and put it in writing - return receipt requested. That way she can't deny you did not inform her. Then make good on your payment on the 8th.
