Does the state of FL favor both parents for shared custody even if one parent has been primary for 7.5 years and takes care of all custodial duties (from taking to school in the morning, every morning, doctors, to signing up and taking child to extracurricular). There is currently no order and now 7.5 years later the other parent is threatening for shared custody that was never an issue before. Other parent does not take child to any of the extracurricular even if it falls on their day. Drops child off to other parent to take to and from anything child's involved in.

Chapter 61 of the Florid statutes directs the Judge to presume shared custody is in the best interest of the child. It will be awarded unless some very extreme factors come into play. The issue is always parental participation, there is no answer.
Under FL law both parents are entitled to share in the raising of their children.
