Who stays in house?

My fiance and I are living in a house that he and his soon to be ex-wife bought a few years ago. In the custody trial of their minor child, she was awarded the right to stay in the house. She could not afford to live there and my fiance moved back in. She refuses to let him buy her out right now, because she is sure that she'll get more money out of the house if he sell it years down the road. If we stay in this house and invest money in remodeling and she all of a sudden decides she wants to move back in, do we have any rights to prevent her from taking the house back?

Florida Law - I assume that you have an attorney handling this divorce and if so the determination of this marital home must be included in either the mediated agreement or at trial. In any event this property must be equitably distributed between the husband and wife before the end of this case and once the case is over and the determination of this property has been made then that is it unless someone appeals the decision.
