Step daughter name change

My sister had a child with a previous boyfriend who wanted nothing to do with the child. My sister, not married, at the time gave the child her last name. She then married and had another child. They were married for eight years. My sister nor her husband never took any steps towards changing my nieces last name. My niece is now wanting to have the same name as the man my sister was married to for eight years. My sister nor my sisters ex-husband have any problem with this. He has called me asking what is the best way to have this done? And least expensive way to have this done now that they are not married? Thank You.
