Legal Question in Family Law in Florida

Step parent adoption... Bio dad is asking to "be released from all rights and responsibility" My son (11yr old) has also asked that my current husband of 9 yrs adopt him. Bio dad now claims that per his lawyer because my husband was arrested and is under a PTI in the local courts that no judge will allow a step parent adoption even with consent... true or false?
