Legal Question in Family Law in Florida
Step parents' rights
I am the step-mother of two children, ages 3 and 4. We are currently in yet another ''custody battle''. The biological mother and custody evaluator have said that I have no rights to these children, such as the right to take them to the doctor. What are my rights as a step parent? Where can I find out more about this?

Re: Step parents' rights
Based on the information provided, you appear to have a common lament of step parents: much responsibility without rights. Your rights are derived from the rights of the father. Assuming the Final Judgment does not restrict his parenting rights such as taking the children to physicians or other places, your rights are as his "agent." However, the "custody evaluator" may advise the court regarding appropriate parenting arrangements given the particular circumstances. You are advised to consult with a local family law attorney, Dept. of Children & Families, or child psychologist regarding issues raised by the evaluator; however, if the evaluator is performing a custody evaluation, you are advised to participate fully with the cooperation of the father since such recommendations may be taken seriously by the court in setting parenting rules.
