Legal Question in Family Law in Florida

Stepfather visitation rights

In our divorce we have the clause first right of refusal. Where one parent has to ask the other parent before having a baby sittier. To give the other parent the option to keep. Now that my X has remarried she leaves my son with his stepfather all the time. Am I still supose to have the option to keep him instead?

Re: Stepfather visitation rights

It depends on the terms of the clause and the agreement in general. But, if silent on this, the right stands. You should be given choice first. This is in keeping with the courts' encouraging relatioships between children and their parents and enforcing biological parents' rights. Except in specific circumstances, step-parents do not have rights.
