Legal Question in Family Law in Florida

Stepmother retaining custody

In the event of my death, or indisposal on a long

term basis, I wish my wife to retain custody of MY

son. I now have legal, uncontested custody. Is

there a way that I can assure my wife that my son

will be with her, and not my ex-wife? Also, I am

concerned with anything I leave my son becoming

my ex-wifes, and him not receiving the benefit.

Thank You!

Re: Stepmother retaining custody

If you were to pass away then your ex wife would be the surviving parent and would get custody of your son unless a petition was filed stating she is unfit and that was proven to be the case.
