Legal Question in Family Law in Florida

Stop Making Child Support Payments

My child turned 18 in April 2000. Child support payments are still being taken out of my checks. I was in arrears but now that has been paid up. I've written letters, including finacial statements, and proof that I owe no more. What can I file with the courts to stop the payments from coming out of my checks and to be refunded the overpayments?

Re: Stop Making Child Support Payments

Your divorce decree should specify that you are no longer responsible. If it or the Income Deduction Order do not have the proper language in it for automatic discontinuing, you can obtain a form at the clerk of court's office to file a motion with the court. Be sure to specifically demand that improper payments be returned by the recipient.
