Legal Question in Family Law in Florida

Support

I had to go to court on Monday 5-7-07 to make arrangements for child support, but I feel there is a discrepancy with the amount I have to pay out per month. They were basing it on my old income of last year (which is more), not my new income since March 2007 (which is less). What can I do to get this corrected or reviewed? Is there also a way I can check for the correct child support I need to pay, like a listing chart etc.

NOTE: This communication is not intended as and should not be interpreted as legal advice. Rather, it is intended solely as a general discussion of legal principles. You should not rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorney's individualized advice for you. By reading the "Response" to your question or comment, you agree that the opinion expressed is not intended to, nor does it, create any attorney-client relationship, nor does it constitute legal advice to any person reviewing such information, nor will it be considered an attorney-client privileged communication. If you do not agree, then stop right here, and do not read any further.

You can calculate your own child support. Florida Statutes 61.30 sets forth that guidelines must be used. The statute and guidelines can be viewed at http://dor.myflorida.com/dor/childsupport/guidlines.html

You can complete the child support worksheet and see how accurate the court was. If you feel that it was in error, you can petition the Court for a modification but you will generally have a better chance with an attorney on your side who knows how to argue the case.
