Legal Question in Family Law in Florida
Support Problem
I was asked by my ex-wife to have my daughter live with me since she could no longer handle her. My daughter is 13 years old . Her grades dropped off and she has a great deal of anger towards her mom. My ex-wife told her that she can not come back to the house until she changes her attitude. My daughter has been living with me for a month now and I have no problems with her. She is a good kid that is simply dealing with teen issues. I have spoken to the asst principle at her school and she said she has seen an improvement in my daughters behavior since she has been living with me. My daughter does not want to go back to her moms house at all. I am still paying my ex-wife the child support every week for the support of my daughter which is now with me. What can I do about it? She did agree via email to repay the support but I have not seen anything from her. What can I do? Do we have to go back to court? Is there some paperwork I can send the court to stop the payment of support. I do not want her to have to pay me support. I just want to stop paying her when my daughter is living with me.

Re: Support Problem
You'll have to go back to court to have custody and child support modified. If you fear that your ex will say, "Oh, so you're taking me back to court? Well, in that case, I want my daughter back immediately according to our old court order," you may want to wait six months or so to establish the new arrangement as the status quo before you go back to court.
