taking a child out of state

If there is no divorce or child custody pending is it legal for a father to travel out of state with his child, even though the mother does not agree to it?

Yes, unless he does it with the intent to prevent the mother from being with the child. The mother should at all times know where they are and be able to communicate with the child. The only thing you can do to stop him is file a petition for custody.
