tax return of 2007

I would like to know if I can get a

copy of my future ex-husbands 2007 tax return?I don't want any problems with the IRS. Quiet frankly

I don't trust him.Would I have to

sign that return if we aren't divorced yet? Can I be protected if

he did anything that isn't legal? Am

I suppose to sign that return myself

even if he has been out of the home for more than a year?

You should be able to obtain your future ex-husband's 2007 tax return as part of mandatory disclosure of financial documents required in Dissolution of Marriage cases. You can file separately in order to avoid becoming entangled in any potential misrepresentations in your husband's return.

When you file for divorce in Florida, both parties have to provide to the other Mandatory Disclosure. Mandatory Disclosure is all of the parties financial information, including tax returns.

You do not have to sign the return if you believe it is fraudulent. I recommend filing separately if you don't agree with his return. If you do end up signing the return, but believe it may have been fraudulent, you can file an "innocent spouse" declaration with the IRS - but I recommend talking to an accountant or tax attorney before you do any of these things.
