Taxes and Child Support

My ex wife brought to court's attention that I owe back child support of 16,000, I have receipts showing proof that she is very much wrong. We had hearing in front of judge and are going to mediation which is coming up soon to show my proof. About a year ago was put on SED and have been paying, all along, never stopped. Question is, why or should my tax refund which is a joint with my new wife be taken away from us. Can I stop that refund from going to my ex and if so how?

You need to staighten out how much it is that you are in arrears. Yes IRS can take the refund that is why some people file married but seperate.

Unfortunately, the IRS just takes the refund and holds it until the judge, magistrate, or hearing officer orders otherwise. It isn't fair, but they assume you are lying until you prove to a judge otherwise.
