Legal Question in Family Law in Florida

My husband has filed an extention to file income tax for the past 5 years. We lived together most of that time. However he has now filed married living singly. I guess i am not entitled to any of the returns in Florida. Is this true. He did this to prevent me from getting any of the return money. He did this for spite since now he owes the goverment when if he had taken me as a deduction we would have had money returned to us. Is this legal. We are currently living apart and in the process of a terrible divorce and custody battle..

You can file as married filing separately, if you want.
