Legal Question in Family Law in Florida

Temporary Relief Hearing

My husband is an over the road truck driver. Although his gross income is well over $100,000 per year he is claiming only $18,000 on his 2000 tax return. I am asking for temporary support and atty fees at the hearing, exactly what type of deductions is he allowed to use. I know about Fuel costs, cell phone cost, truck insurance, truck payment, but what else? Is he allowed to take the expenses for the house, like the garage, the computer room (in our house) 25% of the home telephone 25% of the electric bill or would those deductions be applied to me as well as i helped get him loads? I do not work, I am disabled.

Re: Temporary Relief Hearing

Your husband's earnings of over $100k are not considered "income" for purposes of determining his support obligation. Deductions are allowed for normal and reasonable expenses incurred in order to produce that income.
