Legal Question in Family Law in Florida

I have tempory coustody of my 3 year old niece. The one year court date is coming up and the court will either give her to me or back to her mom. Her mom has not passed any drug tests and has recently married a guy with former charges against him for drugs and domestic violence. Will the court give my niece back to her mom if she starts to pass drug tests this last month? Is there anything I can do to show I think its safer for my niece to stay with me?

One month of no drugs is not a great history of none use. Get a copy of the police record for her and the man she is married to. then for your side, have a lot of witnesses come to court (affidavits are not acceptable) to speak of thegood things you have done with your niece, the fact that she is safe and comfortable in your home etc.
