terminating parental rights

Would my ex-wife legally be able to terminate my parental rights were I incarcerated for 3-5

years? The charge was violation of probation on an aggravated battery charge. She was not

the victim. She was advised by her attorney that she would be able to do so without my permission.

Perhaps, if she shows the court that terminating your parental rights is in the best interests of the child, a court could; however, it is not clear from your information how she would do that. Also, just because your wife stated such as an attorney's opinion doesn't mean that your wife actually heard it or an attorney said it. Doubtful.
