Legal Question in Family Law in Florida

On Time Child Support

My ex has decided to pay half of the child support on the first of the month, and half on the 15th of the month even though the custody agreement requires him to pay it on the first of the month. He made this change on his own which has forced me to rearrange my finances to compensate. Is there anything I can do? Will the judge consider it petty since he is still paying the full amount?

You can file a motion for contempt, though you are correct that some judges will consider it petty.

Re: On Time Child Support

It is unlikely, because of the difficulty of collecting past due child support that the Court would enforce the payment on the first of the month. However, a Judge would likely warn him that he is not following the Court Order and that he runs the risk of being held in Contempt of Court. Brining him to Court may be enough to encourage him to make his payments on the 1st of the month.
