at the time of divorce if the wife is entitled to half of the husbands 401k is the dollar amount determined by the monies there on date of divorce or when the wife actually per sues her half through an attorney

401k is not based on one half - the wife is entitled to that portion at the time of the marriage that she also helped to contribute to. This is not a community property state - it is an equitable distribution.
