Legal Question in Family Law in Florida

I have a time-sharing agreement with my two children ( 7 and 5) in the state of Florida. The mother was granted Primary Physical Residency and I have visitation ( I live in NC). The mother has been in legal trouble. She was sentenced to 270 in county jail and had her license suspended until all fines are paid in full, Fines totaling $14,411.00 (in which she will never be able to pay). I have filed for an emergency pick-up order as well as a supplemental petition to modify our time-sharing agreement. The granmother does not want me to get the children. By law can the judge honestly allow the grandmother to keep the kids instead of me being awarded primary physical residency?

Your rights trump the grandmother's rights. Actually, she has no rights, but I've seen grandparents tie these cases up in court for months. You should get a family law attorney involved right away. Call me if your case is in the Tampa Bay or Orlando area.
