Tools of trade. Marital property?

I am divorcing my wife of 18 yr. I have purchased tools for my work. Are they to be considered in equitable distribution?

Re: Tools of trade. Marital property?

If the tools were purchased by you personally during the marriage, they are subject to equitable distribution just like any other marital property. You may have some "wiggle room" if they were purchased by an LLC or corporation, but you should speak to a family lawyer about that.

Re: Tools of trade. Marital property?

If you purchased them during the marriage of 18 yrs,, then they will be valued and be a part of the equitable distribution.

Your lawyer should help you sort that out and you should have one as there seems to be more assets than just tools that may need protecting.
