Legal Question in Family Law in Florida

Transportation, is it shared?

I am a non-custodial parent. I get to see my son 3 weekends a month, half of the summer, fathers day, etc... I haven't been able to drive since before we were divorce because of epilepsy. My question is this; we both live within 30 minutes of each other, shouldn't the pick up and the drop off of our son be shared?

Re: Transportation, is it shared?

When the agreement was reached it should have been addressed then. If you had the illness then, the transportation issue should have been brought up. If not, and it is creating a hardship on you, certainly you can take it back to Court for that adjustment. Unless you can both agree to it?

This is the kind of thing that probably should have been put into your agreement or judgment.

Given that it isn't, most judges would probably rule that transportation should be shared or, given that you can't drive, that the transportation is the custodial parent's responsibility.
