Legal Question in Family Law in Florida
travel of a minor child to FLORIDA
My daughter of 10 lives with me in Cape Town, South Africa, we are both on Italian passports. She will visit her mother in Florida for our school holidays. How can i ensure that while she is there her mother will not undertake to change my daughters nationality to US or by some other measure to keep her in USA with her, her mother herself is still been nationalised to American as yet. Her mother has custody rights but i have the right of reasonable access ( being in another country is not reasonable), her mother immigrated from South Africa and has married an American. I want to be sure that her mother will have no choice but to send her back at the end of the proposed holiday. My daughter is happy at a good school with close friends and is doing well. Another move would not be in her best interests

Re: travel of a minor child to FLORIDA
You have remedies if something does happen (assuming you have a valid judgment from Italy, South Africa, or other). However, until then, there's nothing to do but follow the terms of your final judgment. Try to keep in touch with your daughter every day. This way, if something happens, you will not go more than one day without knowing.
