Legal Question in Family Law in Florida
Unfit Father
My son's dad has not had any contact with him in 3 years. He has never paid child support, which is fine with me as long as he stays away. He is a convicted felon with prior arrests such as domestic battery, burglary, drug charges, driving on a suspended liscence, etc... I am remarried to a wonderful man and would like him to adopt my son but am afraid to stir something up with my ex since things have been so quiet and peaceful. I am scared he will come around again and want to see our son but am afraid to let him go with his dad (he's 7 years old) because he is a bad man. What are my choices here and what are the chances I can get his visitation revoked?

Re: Unfit Father
It is difficult to answer whether you will be able to obtain Sole Custody, but based on the father's lack of financial and emotional involvement you would have a good chance. The Court could also require the father have supervised visitation. If your new husband is willing, you could attempt to terminate the biological father's rights so your new husband can pursue a step-parent adoption.
