Legal Question in Family Law in Florida
Unmarried Couple Seperating
My boyfriend and I have lived
together for 4 years. I'm really read
to end the relationship but he's
already told me that he refuses to
leave. We own our home together,
we own a car together (which he
primarily drives), we have approx.
$30K in Credit Card debt together
(which is in my name). I really want
to stay in the house, I'm not
interested in the car, and I would like
us to split the cost of repaying the
debt. How should I go about this
since we are not married??

Prior to filing suit, both parties may wish to meet with a professional mediator to try and resolve the dispute. If the parties cannot agree among themselves, you will need to file an action for partition in order to have the rights of the parties in regards to the residence. You should be able to get the court to address the other issues at the same time.

A partition action is the remedy.
