Unmarried and custody

Does a mother have sole custody of her child if she never married the father? The fathers name is on the birth certificate but has never proved paternity. Also custody has not been legally established yet. Mother and father have been cohabitating and fixing to go separate ways.

If the parties cannot agree (in writing) a court proceeding to establish custody is needed.
