unmarried and want to leave state with child can I?

My boyfriend and I are breaking up. We have a son together. I want to move back to my home state. Can I leave the state with our son? Would I be breaking any laws? Do I have full custody of our son since we are not married?

Based on the limited information provided, you would not be acting illegal if you move with your child to another state. However, you should consider whether it is in the best interest of the child for you and the child's father to enter into an agreement acknowledging the paternity of the child, providing for support and visitation, agreeing to the relocation, and agreeing to shared parental responsibility.
