What steps do I take if my ex husband is in direct violation of our divorce decree? What steps do I take if he tries to keep my children after is designated visitation period?

Re: Violation

There are court rules providing for the enforcement of litigant's rights and interfering with custody or visitation is a serious criminal offense. You should call me at 800 273 7933 to discuss your question. You can visit my website by clicking on www.garymooreattorneyatlaw.com

Re: Violation

Thank you for your inquiry.

An application to the Court must be made to enforce your litigant's rights. In other words, a motion must be filed with the Court in order to protect yourself and your child if the noncustodial parent were to seek to violate your previous divorce decree or Court Order.

As it would be my pleasure to speak to you regarding your situation, please feel free to contact my office at 732 246 0909 to discuss same.

Very truly yours,

Re: Violation

You can make an application under R. 1:10-3 for enforcement of litigant's rights. The Rule and R. 5:3-5 (c)(3) provide for attorney fees against an offending party in such situations.
