Violent Wife
My wife is a true psychopath and is violent and abusive. If I take the children and leave can I be charged with kidnapping?

Not if you petition for temporary custody at the same time or before. No matter what, she can contest. At that point, each side will have to offer evidence supporting the claims concerning her mental health status.
