visitation

Children 12 & 14. Parents divorced in 1996. Husband has had visitation as he wishes for years. (not a lot of contact) Children have recently started to tell father that they do not want to go with him when he calls. He is now threatening to go to court for visitation enforcement. How do I get they kids a GAL? I want their wishes to heard. He has been abusive (mostly emotionally) to the kids. At what age can they decide to go or not?

A biological parent is entitled to visitation if there are no reasons showing that they would be against the best interest of the children. The children's wishes are only one factor to consider in that determination and although the court might listen, it may not be a decisive factor. You probably would have to prove that visitation with the father are detrimental to them.
