Legal Question in Family Law in Florida

visitation

I currently live in Ohio, my daughter lives in Florida with her mother, I pay child support for her, we have not ever been married . I would like visitation rights with my daughter. What do I need to do to obtain these rights or do I have any right to visitation.

Normally you would have the same visitation rights regardless of whether you were married. Is the support that you pay Court Ordered, if so, you would file a Petition with that Court to modify the Final Order so as to provide for visitation. If not, you would file a Petition to establish visitation. This would probably be filed in Florida assuming that your daughter has not just moved to Florida.

You are entitled to visitation with your daughter. You will need to file a Petition to Establish Visitation here in Florida. The basic form to do so can be found online, but it's a good idea to have an attorney look it over before you file it. Give me a call or e-mail if I can be of further help.
