visitation prior to hearing

I have a son with a woman i was never married to. He is 17 months old. In the past year we have a verbal agreement about my visitation times, which is every other weekend and one day during the week. My mother also babysits him 3 times during the week for his mother while she works. I have hired an attorney to get my visitation court ordered,and since my sons mother was served the papers she refuses to allow myself or my mother to see my son. I realize she has 20 days to respond to this and then there is also however long it takes to go to court but in the meantime is there any legal recourse i have to be able to see my son? There has never been any legal custody established between us, the only thing is i do pay court ordered child support which is always current.

There are provision for emergency hearings. Exactly what constitutes an emergency, and how long it takes to get the hearing, varies from place to place and judge to judge. Your attorney should be able to advise you on this question.
