Legal Question in Family Law in Florida
Visitation rights
My daughter just turned one, her father and i were unwed. He took a paternity test and is tryin to get joint custody. While i was pregnant he got arrested for domestic violence towards me.... what are the odds i can use this in court to get legal/ physical custody with supervised visitaion because im concerned with my childs welfare because of his violent history.I have let him see my daughter since she was born but under my supervision... he insists he wants to take her from my household... and i deny him the right to see her unless me or one of my family members i present

Re: Visitation rights
Domestic violence is some evidence that supervised visitation is required, but not much. You're probably doing more harm than good to your case by denying him unsupervised visitation, but you should check with a family lawyer in your jurisdiction to be sure.
Re: Visitation rights
Is this a domestic violence case, a divorce case or pssibly a denpendency case? Obviously the paternity test showed him to be the father. Now he can pay child support. Was this a child support enforcement case? You see, the rules are different depending on what ballpark you are playing in.
Best bet! Get a lawyer or have one appointed if you can't afford one (dependency case).
