visitation

my ex is all of a sudden going against a written agreement we both made and both signed in 2003-reference to him taking our son over night on a school night.i don't think this is in the best interest for our son he is only 7 years old and would have to get up 1 hour earlier for him

to bring him back home to get ready for school-he is already in contempt of court also doesn't have a drivers

license.the court order does state''the best intrest of the

child''please help

Certainly not in your son's best interest. How is your son doing in school. You do have options. You should discuss what your options are with an attorney in your area. I believe you are in or near the Stuart area. After trying to resolve this matter with your ex....your only relief might be to petition the court for a modification of the current custody arrangement.

It could be argued that your ex's behavior could be corrected by sanctions or by contempt proceedings instead of changing custody.
