Legal Question in Family Law in Florida

Wage Garnishment

I need help with beginning the process of garnishing my ex-husband's wages. He has recently refused to pay the balance of the ''contractual maintenance'' as outlined in our divorce agreement. If I can file the forms and make the necessary contacts myself I would like to. However, I live in Colorado and he now lives in Florida. Can I do this myself or do I NEED an attorney in Florida?

Re: Wage Garnishment

Employers nationwide should accept service of wage garnishments, regardless of the state it was issued from. However, you might try contacting the employer first to see if they would accept a garnishment prepared under the Colorado order. If for some reason they don't, you should consider getting in touch with the Florida Child Support Enforcement Unit to assist you with enforcing the order.

Hope this helps!

Re: Wage Garnishment

Your Colorado judgment has no meaning in Florida until domesticated.
