what can I do while waiting for vistation to be modifyed to protect my child?
My ex and I were never married, I have sole custody and he has visitation. Our mediation agreement and court order which was signed on 10/25/04 states that he can start having overnight visistation when my son is 6 months of age. He is of age and he has no crib or adequete facilities to take care of a child of this age. He refuses to buy a crib, he wants to put my son on a crib mattress in an adult bed, which is physically dangerous for a baby of his age, according to his pediatrician and the department of children & families. I am filing a request for modification of the order to include overnights happening when he has the proper equipment. In the meantime can I refuse him taking my son overnight while waiting for a court date, or do I have to allow it, even though he could be in danger of physical injury? Is there a temporary document I could file?
