Legal Question in Family Law in Florida

My ex wife is not allowing our son to speak with me becuase of me being behind on child support. The divorce decree says otherwise. That a child has rights and communication has no lines that he or she may speak with each parent at anytime for better or worse with the parents.

She has already contacted the state of florida and trying to come after me for what I owe her. People have told me she is in contempt for this?

What can i do as i am at a loss of words here.

A Motion to Compel Enforcement should be filed. However, I suggest making sure that you can prove that she is attempting to frustrate your relationship with the child. I suggest communicating with her via email. Keep in mind that you might want to show the emails to the Court.

Child support and visitation are totally independant from each other.

The above information is provided without any consideration/payment having been received, and without full knowledge of all of the facts.

An internet inquiry is no substitution for an in-office consultation with an attorney.

If your situation falls within the Greater Tampa Bay area, I would be happy to schedule you for a no obligation half hour office consultation. The main office is in Dunedin, with a satellite location in Tampa.

Feel free to Google me.

Please note that if you take her to court for contempt/enforcement you too need to come with "clean hands" meaning your child support should be caught up.
