Legal Question in Family Law in Florida

Wife still using my name

I was divorced earlier this year. While married, I was on my wife's medical insurance. She has since then received a personal injury settlement. She has called me to inform me that a check will be arriving in MY name in the mail. What should I do? If she is illefally still using my social and name do I have a right to the check? and if not, what can I do to stop her from using my information?

Thanks!

Re: Wife still using my name

It appears that you may have misunderstood your wife. If she was injured while you were still married, she may have instituted a personal injury lawsuit which included a claim for loss of consortium. This claim is for the loss of normal marital relations between spouses. If a settlement was reached in your name, I would argue that you are entitled to keep it because it was given to compensate you. Your ex-wife probably received her own payment separately.

This issued should be reviewed with a competent attorney who can research the facts and fully protect your rights.
