Legal Question in Family Law in Florida

My ex wife has posession of the family home until my youngest child is emancipated in 10 years. She recently informed me she is five months late on the payments. The mortgage is still in both of our names. She has destroyed my credit. Can I sue her for this and the loss of my equity if they forclose on the house? There is equity in the house.

Ask her to renegotiate the terms of your divorce. YOu could refinance the house, lower the payments and perhaps give her a lump sum settlement and you take back the house until you either sell or remain.
